Mediation is a process where disputing parties agree to meet at a neutral location in the presence of an objective and impartial mediator to explore various compromises to settle a dispute before it escalates to a law suit. During a mediation, a mediator will spend equal time looking at both sides to understand the wrongdoing, the injury which arose from the wrongdoing, and the remedy being sought. Once the dispute is clearly understood, the mediator will then consider a variety of factors and propose at least one solution to 'get the ball rolling'. With careful listening and negotiating expertise, a gifted mediator can turn even the most contentious of disputes into an amicable settlement without the need of a law suit ever being filed.
